No-Fault Divorce Signed Into Law

ALBANY - New York now will offer no-fault divorce . A spouse can receive a divorce by declaring under oath that a marriage has been "irretrievably" broken for at least six months.
Other issues related to divorce, custody, visitation, equitable distribution, etc. must first be resolved before a marriage can be dissolved.
Governor Paterson also signed another bill, which requires payment of counsel and experts' fees to the "non-monied" party in a divorce action. Another signed bill establishes a schedule for temporary maintenance payments to non-monied spouses
